Judge Blocks the DOL’s New Overtime Rule

Late in the day on November, 22nd, a federal judge in Texas entered an injunction temporarily blocking the Department of Labor’s new rule governing minimum salaries required to qualify an employee as exempt from overtime compensation. The new rule, which was slated to go into effect on December 1, would have raised the minimum weekly salary from $455 to $913. With the ruling, the minimum required salary will remain at $455. In announcing its decision, the Court held, “This Court concludes that the governing statute for the [FLSA’s white-collar exemptions] is plain and unambiguous and no deference is owed to the Department regarding its interpretation.” The injunction is effective nationwide.
